Privacy policy

1. Controller

Philipp Wiertelorz
Viebigplatz 4
80686 Munich, Germany
Email: philwirt@web.de

2. Website hosting through GitHub Pages

This website is delivered through GitHub Pages. When you visit it, technically necessary connection data may be processed, including your IP address, time of access, requested address, referrer, browser and device information. This processing serves the secure and stable delivery of the website. The legal basis is Article 6(1)(f) GDPR; the legitimate interest is the secure and reliable operation of the website.

The technical provider is GitHub, Inc., 88 Colin P Kelly Jr Street, San Francisco, CA 94107, USA. Processing in the United States cannot be ruled out. Further information: GitHub Privacy Statement.

3. Contact by email

If you contact me by email, I process the information you provide to respond to your inquiry and take possible pre-contractual steps. The legal basis is Article 6(1)(b) GDPR where the inquiry concerns a contract or pre-contractual measures, and Article 6(1)(f) GDPR for other inquiries. The legitimate interest is the proper handling of your inquiry.

4. Contact form and Formspree

The contact form transmits your entries to Formspree only after you submit it and from there to me. The processed data may include first name, email address, optional telephone number, preferred contact method, training frequency, availability, selected goal, free text and technical connection data such as IP address, browser, time and referring page.

Formspree is used as the technical form service: Formspree, Inc., USA. According to the provider, its services are hosted on Amazon Web Services infrastructure in the United States. Formspree states that it relies on Standard Contractual Clauses as a data processor. Data is therefore transferred to the United States. For details, see Formspree's privacy policy and security page.

The legal basis is Article 6(1)(b) GDPR for contractual or pre-contractual inquiries and otherwise Article 6(1)(f) GDPR. The legitimate interest is providing a reliable contact channel protected against automated abuse. The form checkbox merely confirms that this privacy policy has been read; it is not consent used as the legal basis.

Please do not submit sensitive data: In particular, do not enter diagnoses, health data or other data covered by Article 9 GDPR. For an initial inquiry, provide only the organisational information that is necessary.

5. Processing agreement and international transfers

For the productive use of Formspree, processing under Article 28 GDPR, including the provider's stated Standard Contractual Clauses and subprocessors, is documented and reviewed regularly. Where data is processed in the United States, possible risks remain despite contractual safeguards, including broader government access and more difficult enforcement of rights.

6. Retention and deletion

Pure contact inquiries that do not lead to a contractual relationship are generally deleted from the active email inbox and the Formspree inbox no later than six months after final handling, unless legal claims, security incidents or statutory duties require longer retention. If a contract is formed, necessary information is transferred to customer and business records and deleted after the applicable statutory retention periods. Free-text information that is no longer required is deleted earlier.

7. Local browser settings

The website does not use analytics or advertising trackers. Your chosen display and language may be stored locally in your browser using Local Storage. This function alone does not transmit the information away from your device. You can delete it through your browser's website-data settings.

8. External links

The website links to external services such as Instagram or Gumroad. Your browser connects to those providers only after you open a link. Their own privacy information applies to their processing.

9. Your rights

Subject to the GDPR, you have rights including access, rectification, erasure, restriction of processing, data portability and objection. Where processing is based on consent, consent can be withdrawn for the future. You may also lodge a complaint with a data-protection supervisory authority. The competent authority is, in particular, the Bavarian State Office for Data Protection Supervision, Promenade 18, 91522 Ansbach, Germany, www.lda.bayern.de.

10. Requirement to provide data

You do not need to submit contact-form data merely to view the website. To reply to an inquiry, I need at least a working email address. Without it, I cannot respond.

11. Changes

This privacy policy will be updated if the services used, processing activities or legal requirements change.
